As outlined in Utah Code 41-6a-203, the following is the Enoch City ALPR policy that outlines the use, management, and auditing of the the Automatic License Plate Reader System (ALPRS)
Enoch City Automatic License Plate Reader Systems (ALPR) Policy Effective Date: September 17, 2025 INTRODUCTION Enoch City is committed to improve public safety, enhance enforcement of traffic laws, and assist in locating missing persons and stolen vehicles. This policy of the use of ALPR systems by law enforcement can ensure lawful use of ALPR technology, safeguard personal privacy, and provide for public transparency and accountability in compliance with Utah Code § 41-6a-2003. Section 1. Authorized Uses Enoch City may use ALPR systems only for the purposes authorized by Utah Code § 41-6a-2003, including but not limited to:
Active criminal investigations.
Apprehension of individuals with outstanding warrants.
Locating missing or endangered persons.
Identifying or recovering stolen vehicles.
Accessing the Utah Criminal Justice Information System to verify registration, insurance, or vehicle identification.
Regulation of City-owned parking facilities.
Control of access to secured municipal areas.
Any other purposes expressly authorized by Utah Code § 41-6a-2003.
Section 2. Restrictions
ALPR systems shall not be used for general surveillance or monitoring without a lawful purpose.
Data used for research or analysis shall be anonymized.
Stationary ALPR devices on state highways shall not be installed without a special use permit from the Utah Department of Transportation.
Section 3. Data Management and Retention
ALPR data shall be securely stored with access limited to authorized personnel.
Captured data shall not be retained longer than nine (9) months, unless required for an active investigation, pending legal proceeding, or court order.
After expiration of the retention period, data shall be permanently deleted.
Section 4. Auditing and Oversight
The Police Department shall conduct quarterly audits of ALPR use.
Annual reports of audit results shall be provided to the City Council.
Section 5. Transparency
This policy, and any UDOT permits for stationary devices shall be posted on the City’s official website.
Section 6. Sunset and Review
This ALPR policy shall be reviewed by the City Council every two (2) years to evaluate compliance, effectiveness, and community impact.
At the time of review, the City Council may amend, repeal, or reaffirm this resolution as appropriate.
